When to Use Affidavits in Israel Inheritance Law

The application for a succession order or will probate order must be filed according to the form prescribed in the regulations and prepared as an affidavit.  (You can find our article with the link to application forms for inheritance issues, and the applications can be filled out in English, French, or Hebrew.).  Each of the applications must be accompanied by a payment as well, and we provide information about the payments and links to the payment site in the linked articles. The applicant must sign the application before an attorney who verifies the applicant’s signature.

Any other applications to raise an objection must be accompanied by an affidavit in support of the facts detailed therein.  This applies to applications that request to annul a will, delay the execution of a will, or a request to amend the writer’s mistake in the will.

It is important to note that other applications submitted to the registrar may be accompanied by an affidavit and the registrar may also request that an affidavit be attached to support the facts detailed in the application.
